Once registered, according to art. 13 paragraph 4 Legislative Decree 196/2003, we may send you e-mails concerning similar services to those you already used, and you will be able at any time to oppose to such sending.

FFO independently establishes the purposes and methods of data processing as well as the implementation of security procedures to guarantee the privacy, integrity and availability of personal data belonging to anyone accessing and surfing the website (hereafter said “users”).

Personal data are collected by the data controller, according to the directions provided by the Privacy Code, particularly in regard to the minimum security measures, (articles 33-34), concerning data processing through IT (electronic) devices (article 35), through manual or automated tools and by logics strictly connected to the above mentioned purposes, and in anyway able to ensure the security and the privacy protection of the personal data provided.

 

Communicating your personal data to FFO when requested, in any of the many instances where personal data is collected through the website, may be essential in order to achieve the purposes set down by the communication itself, or not prejudicial in this regard.

If you refuse to communicate the information marked as compulsory to FFO, it will be impossible to achieve the main purpose of the specific data collection: such a refusal might for example make it impossible for FFO to fulfill the product sale agreement on the website or provide the other services available on the website (assistance – forwarding of the newsletter).

The user has in any case the right to totally or partially oppose to the processing of his/her personal data, when proving the presence and validity of legitimate grounds for opposition.

 

The user may in any case have the right to oppose to the processing of his/her personal data for the purposes of advertisement, or direct marketing mailing, or if used for the purposes of market surveys or commercial communications.

 

However, we wish to inform you that the law regulating the protection of personal data, art. 130, paragraph 4, Legislative Decree 196/2003, permits to use personal data for direct selling activities, involving products similar to those already purchased by the user, without any obligation to obtain the user’s prior consent, unless the user refused to allow such use of the e-mail address he/she communicated.

 

The new rules on simplification of the requirements for processing operations for administrative and accounting purposes included in the Italian Privacy Authority Provision dated June 19th 2008 will also be applied. The above stated Provision permits to use the user’s postal address for sending him/her, together with administrative and accounting documents, advertising concerning products similar to the ones already purchased, unless the user explicitly refused to allow such use of his/her postal address.

6. FFO commitments

 

FFO is committed to:

 

  1.     Process data exclusively for the purposes and according to the methods illustrated in the notice presented to users at the time of its collection;

 

  1.     Use data for other purposes, with respect to those specified at the time of collection, only where the user has expressed its express consent to such use;

It could happen that FFO may find itself processing personal data of third parties, communicated directly to FFO by its own users, such as when a user has bought a product to be delivered to a friend, or when the person who pays for a product is different from the addressee.

In these circumstances FFO will deliver the notice pursuant to art. 13 of the Legislative Decree 196/2003 to the third party, when the personal data of the same is registered in its archives; it is however your own responsibility to obtain consent from this person before communicating his/her personal data to FFO and to inform him/her about this Privacy Policy, because the user will be the sole person responsible for communication of information and data about third parties without them having granted their consent, or in the event that such data are used in an illicit or improper way.

We wish to inform you that the consent of these persons is not required when their data are communicated to FFO in order to conclude a contract with FFO in their favor.

FFO reserves the right to eliminate the accounts and all related data if illicit contents are discovered that are harmful to the image of FFO and/or its products or those of third parties or in any case may be considered offensive, may be seen to promote illegal or libelous activities, includes pornographic material, incite to violence or promote discrimination based on race, gender, religion or sexual orientation.

 

8. Security measures

FFO adopts the necessary security measures to reduce to the minimum the risk of data destruction or loss -even if accidental-, unauthorized access or illicit data processing, as well as data processing which is not in accordance with the users’ personal data collection.

 

However, FFO cannot guarantee to users that the security measures adopted to protect the website and the data transmission, limit or exclude any risk whatsoever of unauthorized access, data dispersion by user’s devices, generated for example by software not appropriate to protect data transmission on the net, both incoming and outgoing, (as up to date antivirus filters).
